1. Operator and scope
Pokémon Definitive is operated by an independent individual hobbyist operating Pokémon Definitive from the Republic of Serbia (the “Operator”, “we”, “us” or “our”). These Terms apply to this website, its interactive World Atlas, Pokédex, browser demo tools, development information, public patch links and other project-authored website features.
Pokémon Definitive is an independent, non-official fan project. It is not sponsored, endorsed, authorized by or affiliated with Nintendo, GAME FREAK, Creatures Inc., The Pokémon Company or their affiliates.
2. Acceptance
By accessing or using the site you agree to these Terms. Features that provide a project patch or other project software may also require affirmative acceptance of the Project EULA. If you do not agree, do not use the affected feature.
You must have legal capacity to agree to these Terms. A person who is not old enough to enter a binding agreement in their jurisdiction should use the site only with permission and supervision of a parent or legal guardian. Payments through third-party providers are restricted by the provider’s own age and account rules.
3. Fan-project and intellectual-property notice
The site discusses and interoperates with Pokémon games as part of a fan-made hobby project. Pokémon names, characters, game assets, logos and other third-party material remain owned by their respective rights holders. No ownership of third-party material is claimed, and no license to third-party intellectual property is granted by us.
Our disclaimers do not convert unauthorized use into authorized use. If a rights holder objects to material on the site, it may use the process described in our IP & Takedown Policy.
4. Free access and no sale of Pokémon content
Public project access is intended to be free. We do not sell a commercial Pokémon ROM, a license to Pokémon intellectual property, guaranteed access to future builds, or rights in any third-party game.
Public releases are intended to be distributed as patch files or other transformation data rather than commercial base-game ROM images. You are solely responsible for obtaining any compatible base game lawfully and for determining whether your use is legal where you live.
5. Acceptable use
You may use the site for personal, lawful, non-abusive purposes. You may not: interfere with the site or its infrastructure; bypass security or rate limits; introduce malware; impersonate the Operator or a rights holder; falsely claim official affiliation; use the site to distribute pirated commercial ROMs; use the site to facilitate unlawful activity; scrape or overload services in a way that materially impairs availability; or use project-authored material in a misleading commercial offering.
6. Downloads, patches and browser tools
Downloads, patching tools and emulator-related features are provided for convenience and hobby use. You are responsible for backups, compatible hardware/software and the legality of any game file you select. A local browser demo may process a file on your device; unless a feature clearly says otherwise, the project does not need to upload your selected ROM to our server.
Do not use the site to obtain, request, host or distribute a commercial ROM that you do not have the legal right to possess or share.
7. Donations are optional and separate
Donations are completely optional. They are not a price, subscription, purchase, preorder, crowdfunding entitlement or condition of access. Donating does not provide a patch, ROM, exclusive build, feature, vote, support priority, ownership interest, credit, employment relationship or promise of continued development.
Additional rules are in the Donation Policy. Payment processing is performed by the selected third-party payment provider under its own terms.
8. Third-party services
The site may link to or technically rely on third-party services such as PayPal, PokéAPI, GitHub-hosted resources or an emulator/CDN provider. Those services are independent of us and governed by their own terms, privacy policies and availability. A link is not an endorsement or guarantee.
9. No warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, PROJECT FILES, PATCHES, TOOLS, DOCUMENTATION AND DEMOS ARE PROVIDED “AS IS” AND “AS AVAILABLE”. We do not promise that they will be error-free, continuously available, compatible with your device, safe for every save file, accurate in every detail or suitable for a particular purpose.
Development builds may contain bugs, unfinished content, crashes, balancing issues or save-compatibility problems. Back up important files before testing them.
10. Assumption of technical risk
You choose whether to use development software, patches, emulators or original hardware. To the extent permitted by law, you accept the ordinary technical risks of hobby software, including corrupted saves, lost progress, crashes, incompatibility, flashcart problems or the need to restore a backup.
11. Limitation of liability
To the fullest extent permitted by applicable law, the Operator will not be liable for indirect, incidental, special, consequential or punitive loss, loss of data, loss of profits, loss of opportunity or damage resulting from voluntary use of this free hobby project.
Where liability cannot lawfully be excluded, it is limited only to the maximum extent the applicable law allows. Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from intentional misconduct, fraud, gross negligence where non-waivable, or mandatory consumer rights.
12. Responsibility for your conduct
To the extent permitted by law, you are responsible for claims, losses or costs caused by your unlawful use of the site—for example, uploading or distributing material you had no right to distribute, falsely claiming official affiliation, or using the project as part of an unlawful commercial ROM distribution service.
13. Changes, suspension and discontinuation
This is a hobby project. Features, builds, routes, release plans and the website itself may change, pause or end without a promise of continued development. We may restrict abusive access or remove material where reasonably necessary for security, legal compliance or rights-holder requests.
Material changes to these Terms will be posted with a new effective date. When reasonable, features requiring affirmative acceptance will ask you to accept a materially revised version again.
14. Governing law and mandatory rights
Subject to mandatory rules that apply to you, these Terms are governed by the laws of the Republic of Serbia. Disputes will be handled by courts having lawful jurisdiction in Serbia unless mandatory consumer or procedural law gives you a non-waivable right to another forum.
No clause is intended to deprive a consumer or other protected person of rights that applicable law makes mandatory.
15. Severability, no waiver and entire terms
If a provision is invalid or unenforceable, it will be applied to the maximum lawful extent and the remaining provisions remain in effect. Failure to enforce a provision once does not waive it. These Terms, together with any policy expressly incorporated into them, form the agreement governing the relevant site use.
